Fine Schedule for Unauthorized Vegetation Changes

FINE SCHEDULE FOR UNAUTHORIZED VEGETATION CHANGES IN THE COMMON AREA

The Chinquapin CC&Rs at Article II, Section 2, Common Area, provide that “No owner shall cut, trim, prune, remove, replace or otherwise alter of affect the appearance or location of any living tree, plant, or other vegetation located in any portion of the Project Common Area without the prior written consent of the Association”.

Further, since Chinquapin is a forested environment on the shores of Lake Tahoe, the property also is governed by the rules and regulations of the California Division of Forestry, and the TRPA. Both of these entities have strict rules and regulations regarding the alteration of all types of vegetation, and have the authority to levy substantial fines for violations of the policies.

The Board has developed and communicated a process for Homeowners to request tree and brush trimming or removal. Requests will be acted upon in consultation with our Forester so as to insure compliance with applicable rules and regulations of the California Department of Forestry, the TRPA, and the aesthetics of our property.

As a part of our fiduciary responsibility to protect the Association, the Board has adopted a Schedule of Fines that will be levied against individual Homeowners in the event of future violations. We have based the schedule on TRPA fines that have been levied and/or threatened at Chinquapin and other properties. Additionally, the Association may recover from the offending Homeowner the cost of restoring or replacing any vegetation.

Unauthorized removal, cutting, or trimming of bushes within 10 feet of the high water mark of lakeshore -- $3000 per bush.

Unauthorized removal, cutting, or trimming of bushes beyond the 10-foot perimeter of the high water mark of the lakeshore -- $2000 per bush.

Unauthorized removal, cutting, topping, trimming or limbing of trees anywhere on the property -- $1000 per inch of diameter of the tree measured one foot from ground level.

If the Association is fined by the TRPA in an amount greater than the above CHOA schedule, those amounts will be passed through to the Homeowner.

Due process will be used to determine the offending Homeowner. Fines will be levied by the CHOA Board of Directors and billed to the Homeowner.

Money collected under this fine schedule will be used by the Board to maintain and improve the forested environment and health of the Chinquapin property.
